Market One Terms of Use

Effective date: 12 October 2026

1. Who we are and what these terms cover

These terms are an agreement between you and DAY NIGHT SIGNS INC, a company incorporated in the United States, of 1715 N Graham St, Stephenville, Texas 76401-2201, United States ("we", "us", "our"). Our full company details are in section 23.

They cover the Market One mobile app (the "App") and our website at https://marketone.click, including the broker directory behind the App (together, "Market One").

By installing or using Market One you accept these terms. If you do not accept them, do not use Market One.

Please also read:

  • our Privacy Policy, which explains how personal data is handled;
  • our Risk Disclosure, which explains the risks of the products that brokers offer.

Your broker's own client agreement, privacy notice and risk disclosure are separate documents. They govern your trading account.

2. The short version

  • Market One is software, and we are only a technology and software provider. We supply a trading terminal that connects you to your broker's own trading platform, in the same way as other trading-platform vendors.
  • We are not a broker, dealer, investment adviser, payment institution or custodian. We do not open trading accounts, hold client money, execute or route orders, set prices or give advice.
  • Your broker is the only provider of your trading service. It provides your account and the prices, executes your orders, handles your money, checks your identity and gives you support, and it is responsible to you for all of this.
  • The App is a client terminal for your broker. It shows quotes, charts, your orders, positions, history and an account overview. Deposits, withdrawals, identity verification and profile changes only open your broker's own web pages. We never handle your money or your documents.
  • Market One is not offered in the United States, India, Indonesia, mainland China, Russia or Belarus, or in countries and regions under comprehensive United States sanctions (section 6).
  • You must be 18 or over.
  • Trading CFDs and foreign exchange on margin is high risk. You can lose all the money in your trading account.
  • These terms are governed by the law of the State of Texas, but you keep the mandatory consumer and data-protection rights of the country where you live (section 17).

3. What Market One is

Market One is a trading terminal (client software). It lets you:

  • find a broker in our directory and see the information that broker has given us about itself;
  • sign in to a trading account that you already hold with that broker, using the login the broker gave you;
  • see quotes and charts, place and manage orders, and see your open positions, your history and an overview of your account, all as provided by the broker's own trading server;
  • open the broker's own web pages for deposits, withdrawals, identity verification and profile changes; and
  • find your broker's support contacts.

When you sign in, the App connects directly from your device to your broker's server. Your orders travel from your device to your broker. We do not receive, route, check or execute them, and we are not in the order path.

4. What we are not

We are not a broker, dealer, investment firm, investment adviser, bank, payment institution, e-money institution, custodian or exchange. In particular, we do not:

  • open, approve or manage trading accounts;
  • hold, receive, transfer or safeguard client money or assets, or process payments;
  • receive, transmit, route, execute or deal on your orders, or act as the counterparty to your trades;
  • set prices, spreads, leverage, margin requirements, overnight charges, fees, products or trading hours;
  • verify your identity, receive your identity documents or carry out anti-money-laundering checks;
  • provide customer support for your trading account, or decide your complaints about it;
  • give investment, financial, legal or tax advice, or recommend any broker, product or trade.

Nothing in Market One is a recommendation, an offer or an invitation to buy or sell any financial product. This includes the directory, the prices, the charts and the order in which brokers appear in search results. A broker appears in the directory because it has met our listing rules, not because we endorse it.

5. Your broker

Your broker is the company that provides your trading account. It is a separate business from us, and it is the only provider of your trading service. Your broker:

  • is the party you contract with for trading, and is usually the counterparty to your trades;
  • provides the prices you deal at, and executes or deals your orders;
  • holds your money and processes your deposits and withdrawals;
  • verifies your identity and age, and runs anti-money-laundering checks;
  • decides which products, leverage and account conditions it offers you;
  • gives you support, handles your complaints, and is responsible for its own licences and legal compliance;
  • is responsible to you for all of its services.

Your relationship with the broker is governed by the broker's own documents. Read them before you trade.

Deposits, withdrawals, identity verification and profile changes take place on the broker's own web pages. The App only opens them for you, in your phone's built-in browser. Those pages belong to the broker, and the broker's terms and privacy notice apply to them. We cannot see what you enter there.

5.1 Broker information shown in Market One

For each broker the App shows the display name, the legal entity, the regulator and licence number the broker has given us, the countries it serves and its support contacts. When a broker has given no regulator details, the App says "Regulator: not provided".

  • We check this information when a broker joins and from time to time after that, under our Broker Onboarding and Delisting Policy. We cannot guarantee that it is complete, current or correct, or that a broker is solvent or behaves properly.
  • Being listed does not mean a broker is regulated. "Regulator: not provided" means the broker may not be supervised by any financial authority, which can leave you with less protection if something goes wrong.
  • Before you send money to any broker, check it yourself, including on the public register of the regulator it names.

5.2 Demo-only brokers

Brokers marked "Demo only" offer practice accounts with virtual money. You cannot deposit, win or lose real money with them. Results on a demo account do not show what would happen on a real account.

5.3 When a broker leaves Market One

We may suspend a broker or remove it from the directory at any time, with or without notice to you. For example, we may do so if we have concerns about its conduct, if it breaks our rules, or if an app store, a court or an authority requires it. A broker can also choose to leave.

If that happens:

  • the broker may no longer appear in search, and you may no longer be able to reach your account with it through the App;
  • the removal itself does not change your account with the broker, your money or your open positions; they remain the broker's responsibility;
  • to manage your account, contact the broker directly through its own website, email or phone.

Keep your own note of your broker's contact details and of other ways to reach your account, such as the broker's web platform, so that you never depend on the App alone.

6. Who can use Market One, and where

  • You must be at least 18 years old, or the age of legal adulthood where you live if that is higher.
  • You may use Market One only where doing so is legal for you. Some brokers and products are not available in some countries. You are responsible for following the laws that apply to you, including tax rules.
  • Countries where we do not offer Market One. We do not offer Market One in the United States, India, Indonesia, the People's Republic of China (mainland China), the Russian Federation or Belarus. Do not use it while you are located in, or if you are resident in, any of these countries.
  • Sanctions and export controls. We are a United States company, so United States sanctions and export-control laws apply to Market One. You must not use Market One:
    • while you are located in, or if you are ordinarily resident in, a country or region that is subject to comprehensive United States sanctions or a United States embargo, or that the United States Government has designated as supporting terrorism (at the date of these terms, for example, Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk and Luhansk regions of Ukraine);
    • if you are, or act for, a person or entity named on a United States Government list of prohibited or restricted parties (such as the Specially Designated Nationals and Blocked Persons List), or who is owned or controlled by one; or
    • in any other way that would breach the sanctions or export-control laws that apply to us or to you.
  • You must not use a VPN or any other means to get around these restrictions. We may block access, or refuse or end service, where we reasonably believe that it is needed to comply with the law.

7. Signing in and keeping your account safe

  • Your login name and password are issued by your broker. The App sends them only to your broker's server, over an encrypted connection. The App does not store your password.
  • After you sign in, the App keeps the session keys issued by your broker in your device's secure storage, so that you stay signed in.
  • If you turn on biometric unlock, your device's operating system checks your face or fingerprint. The App only learns whether the check succeeded.
  • Keep your device and your login details secure, and do not share them. Anyone who can unlock your device may be able to use an account saved in the App.
  • If you think someone else has used your account, use "Sign out of all devices" in the App, change your password, and tell your broker at once.
  • We will never ask you for your password, a verification code or remote access to your device.

8. Prices, information and orders

  • Prices, charts and account figures come from your broker's systems. They may be delayed or interrupted, and they may differ from the price at which an order is actually filled. Your broker's records decide what was executed and at what price.
  • An order is placed only when your broker's server accepts it. Check the result shown in the App and in your broker's records. If you are not sure whether an order went through, check before you send it again.
  • Mobile networks, devices and servers can fail. Keep another way to reach your account, such as the broker's web platform or its dealing desk.
  • Charts show past prices. They do not predict future prices.

9. Fees

We do not charge you for the App. Your broker sets its own charges, such as spreads, commissions, overnight financing and payment fees; ask your broker about them. Brokers may pay us for the use of our technology and services.

10. Your licence to use the App

We give you a personal, non-exclusive, non-transferable licence, which we may withdraw, to install and use the App on devices you own or control. You may use it for your own accounts with your brokers, in line with these terms and the rules of the app store you downloaded it from. If you downloaded the App from Apple's App Store, section 18 also applies to this licence.

You must not:

  • copy, change or distribute the App, or reverse engineer it, except where the law allows you to;
  • use automated tools to access Market One or the directory, or use them in a way that could overload or harm them;
  • try to get around any security measure, or access accounts or systems you are not allowed to access;
  • use Market One to break the law, to abuse the market, or to mislead anyone, including by pretending to be a broker or another person;
  • remove copyright, trademark or attribution notices, including the attribution of the chart library.

11. Intellectual property

Market One, its software and design, and the Market One name and logo belong to us or to our licensors. Broker names and logos belong to the brokers. The App includes open-source and third-party software, including a chart library from TradingView; their licences and notices are listed in the App under Settings → About. These terms give you no rights in any of them beyond the licence in section 10.

12. Changes to Market One and availability

  • We may change, add or remove features, and we may ask you to update to a newer version to keep using the App.
  • We aim to keep Market One available, but we do not promise that it will be uninterrupted, free of errors or available in every country. We may pause it for maintenance or for security reasons.
  • The directory may show short notices in the App, for example about planned maintenance.

13. Ending your use

You can stop using Market One at any time: sign out, remove your saved accounts and uninstall the App. To ask your broker to close your trading account and delete your data, see Delete your account.

We may suspend or end your access to Market One if you break these terms, if the law requires it, or to protect users or our systems. This does not close your account with your broker.

Sections 4, 5, 11 and 14 to 22 continue to apply after your use ends.

14. No warranties

Market One is provided "as is" and "as available". As far as the law allows, we make no promises about it beyond those written in these terms. In particular, we do not promise that it suits your purposes, that the information shown is accurate or complete, or that any broker is right for you.

Some countries do not allow certain warranties to be excluded. Where that is the case, those warranties apply only to the extent the law requires. This section does not affect your legal rights as a consumer.

15. Our liability

Nothing in these terms limits any liability that the law does not allow us to limit, such as liability for death or personal injury caused by our negligence, for fraud, or for gross negligence or wilful misconduct where the law where you live does not allow it to be limited.

Subject to that, and as far as the law allows:

  • we are not responsible for what any broker does or fails to do, including its prices, execution, handling of your money, solvency or compliance with the law;
  • we are not responsible for trading losses or missed opportunities, or for the outcome of any trading decision. This includes losses caused by market movements, by delayed or interrupted prices, or by orders that were not sent or not executed because of a network, device, broker-server or App problem;
  • we are not responsible for losses that were not reasonably foreseeable when you started using Market One;
  • our total liability to you for all claims relating to Market One is limited to one hundred US dollars (USD 100).

If you are a consumer, you may have rights under the law of the country where you live that these terms cannot exclude or limit. Those rights are not affected.

16. Complaints and disputes

  • About your trading account, including trades, prices, deposits and withdrawals: contact your broker. It is responsible for these matters, it has its own complaints procedure, and it may belong to an ombudsman or dispute-resolution scheme.
  • About the App, the directory or us: write to support@marketone.click. We will acknowledge your complaint and try to resolve it as quickly as we can.
  • About a broker's conduct: please tell us as well. We review such reports under our Broker Onboarding and Delisting Policy. We cannot decide disputes between you and a broker, and we cannot recover money for you. If you suspect fraud, also contact the police and the relevant financial regulator.

17. Governing law and courts

These terms, and any dispute about them or about Market One, are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. The state and federal courts located in Texas have jurisdiction over such disputes.

This choice of law and courts does not take away any protection you have under the mandatory consumer-protection and data-protection laws of the country where you live. If you use Market One as a consumer, those laws still apply to you, and you may also bring a claim in the courts of the country where you live where the law allows. Nothing in this section affects your right to complain to a data protection authority.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these terms.

18. Apple App Store: licence terms

If you downloaded the App from Apple's App Store, these terms are the licence agreement for the App, in place of Apple's standard licence agreement, and the following also applies:

  • Who the agreement is with. These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
  • Scope of the licence. Your licence is limited to using the App on Apple-branded products that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may also be used by other accounts associated with you through Family Sharing or volume purchasing.
  • Maintenance and support. We alone are responsible for providing any maintenance and support for the App, as described in these terms or as the law requires. Apple has no obligation at all to provide maintenance or support for the App.
  • Warranty. We alone are responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the App fails to meet any warranty that applies to it, you may notify Apple, and Apple will refund the purchase price, if any, that you paid for the App. To the maximum extent the law allows, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our sole responsibility.
  • Product claims. We, not Apple, are responsible for addressing any claims by you or any third party about the App or your possession or use of it, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • Intellectual property claims. If a third party claims that the App or your possession or use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  • Legal compliance. You confirm that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties (see also section 6).
  • Contact. Questions, complaints or claims about the App should be sent to us, using the details in section 23.
  • Third-party terms. You must comply with any third-party terms that apply when you use the App, such as your mobile network operator's terms and, for your trading account, your broker's terms.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

19. Google Play

If you downloaded the App from Google Play, Google Play's terms also apply to your download and use of the store. These terms are between you and us, not Google.

20. General

  • If a court finds part of these terms invalid, the rest stays in force.
  • If we do not enforce a right straight away, we can still enforce it later.
  • We may transfer our rights and duties under these terms to another company, for example if our business is sold, as long as your rights are not reduced. You may not transfer yours.
  • These terms, together with the Privacy Policy and the Risk Disclosure, are the whole agreement between you and us about Market One.
  • If these terms are translated, the English version applies where the versions differ, unless the law where you live requires otherwise.

21. Changes to these terms

We may update these terms. We will publish each new version at https://marketone.click/terms with its effective date. For significant changes, we will also tell you in the App before they take effect. If you keep using Market One after a change takes effect, the new terms apply. If you do not agree with them, stop using Market One.
